Most attorneys and former judges utilize a caucus or shuttle-style mediation, where the mediator has the parties in separate rooms and will “shuttle” between the individual rooms to negotiate terms for an agreement. This approach tends to make the parties more defensive and disconnected. Shuttle mediation tends to leave disputants feeling “unheard and pressured to get an agreement drafted on the spot” (Zumeta, 2000).
Facilitative mediation, on the other hand, focuses heavily on facilitating communication between the parties while also encouraging the parties to discuss their positions, interests, and desired outcomes for an agreement.
